<p>Some Montreal tenants who say their landlords have left them in the cold demonstrated today in an attempt to get the attention of Quebec&rsquo;s rental board.</p>
<p>They staged a protest outside the board&rsquo;s offices in downtown Montreal, out of frustration over « excessive » waits for hearings on the issue.</p>
<p>Community organizer Sheetal Pathak said that many landlords try to save money by not turning on the heat until December.</p>
<p>Pathak says she&rsquo;s heard a wide range of excuses from landlords, including « I don&rsquo;t have to put the heat on until there is snow on the ground. »</p>
<p>The city and the rental board recommend that landlords keep temperatures at 21C year round. But in cases where apartments temperatures dip below that level, tenants must wait for the rental board to address the situation, said Pathak.</p>

<p>Margaret Prince has been fighting for a wamer apartment for three years. She says her cold apartment has compounded her bladder problems.</p>
<p>« My apartment was so cold, when I&rsquo;d come in from outside I couldn&rsquo;t get warm, » she said.</p>
<p>Once a tenant sends a complaint to the rental board, they could be stuck waiting for months, or even years, said Pathak.</p>
<p>The rental board has no way to deal quickly with cases like Prince&rsquo;s, she said, where the health and security of the resident could be at risk.</p>
<p>She added tenants can sometimes wait up to 20 months for a hearing and even if the case is marked as urgent, it can take up to two months.</p>
<p>« We think it&rsquo;s completly unfair, » Pathak said. « Tenants who are stuck in this situation cannot get justice at the rental board. »</p>
<p>« People end up waiting many months in the winter in badly-heated apartment. »</p>
<p>Pathak hopes today&rsquo;s demonstration will raise awareness about the living conditions of many Montrealers.</p>
<p>« The point is to show how ridiculous it is that people have to take measures to fend for themselves, » she said.</p>

<p>C’est ainsi que les chercheurs et chercheuses du Département des sciences juridiques de l’UQÀM, en collaboration avec Pro <span class="text_exposed_show">Bono UQÀM et Projet Genèse, ont entrepris une étude des jugements de la Régie du logement. En se basant sur une analyse de ces jugements, sont enfin disponible des statistiques indépendantes qui démontrent le fondement arbitraire de la catégorisation des causes mise au rôle. Celle-ci ne repose sur aucune base légale et se fonde sur une interprétation arbitraire de la notion de préjudice sérieux.</span></p>

Claire Abraham, organisatrice communautaire au Projet Genèse, a contacté Métro mercredi après-midi. Elle a expliqué que l’étude statistique des délais à la Régie du logement avait été effectuée sur les 45 cas de moisissures répertoriés où le locataire, plutôt que le propriétaire, avait déposé la plainte. Le problème soulevé par Métro n’affecte donc pas le résultat de l’étude. La moyenne de délai pour ces cas atteint donc 790 jours, plutôt que 762 jours.</em></p>
<p>Certaines causes bénéficient de délais beaucoup moins important que d’autres devant la Régie du logement du Québec, selon une étude des jugements de la Régie entreprise par le département des sciences juridiques de l’Université du Québec à Montréal (UQAM), en collaboration avec Pro Bono UQAM et Projet Genèse, publiée mardi.</p>

<p>Selon l’étude, les délais de traitement des dossiers où la présence de moisissures a été alléguée sont beaucoup plus longs que lorsqu’un propriétaire porte plainte pour non paiement de loyer. D’après les auteurs du rapport, cela prouve que la Régie accorde plus d’importance aux cas de non paiement de loyer qu’aux plaintes des locataires.</p>
<p>«L’accès à la justice à la Régie du logement est disproportionnément à l’avantage des propriétaires», affirme Isabelle Monast, du Regroupement des comités logement et associations de locataires du Québec (RCLALQ), en réaction au rapport.</p>
<p>Un sentiment que partage Claire Abraham, organisatrice communautaire au Projet Genèse, qui a participé à l’élaboration du rapport.</p>
<p>«Souvent le gens n’auront pas recours à la Régie en premier lieu. C’est une des raisons pour laquelle à la Régie, seulement 10% des causes sont soumises par des locataires. C’est parce que, si ça va prendre deux ans, à quoi ça sert ?» lance-t-elle.</p>

<p><strong>Questions quant à la méthodologie</strong></p>
<p>Le rapport affirme que les délais peuvent atteindre 762 jours en moyenne lorsqu’il y a des allégations de présence de moisissures dans un logement. Pour en arriver à ce chiffre, on a étudié 187 décisions de la régie où le mot «moisissure» prend une place importante.</p>
<p>Le plus long délai encouru par une cause étudiée dans le rapport est de 3216 jours, pour une plainte déposée en 2004 et finalement entendue en 2013.</p>
<p>Or, vérification faite par Métro, les moisissures ne semblent pas être au coeur de cette cause. Dans le jugement, rendu par le juge François Leblanc, on peut lire que la plainte a été déposée par la propriétaire, qui demandait le recouvrement d’un loyer non payé. La locataire avait expliqué qu’elle avait quitté l’appartement à cause de présence de moisissures, mais n’en avait jamais averti la propriétaire, et n’a pas réussi à le prouver au juge, qui a tranché en faveur de la propriétaire.</p>
<p>Une autre cause, qui elle a pris 1826 jours avant d’aboutir à une décision – le septième plus long délai répertorié par les auteurs du rapport – est de nature similaire. Dans la décision, rendue en 2012 par la juge Jocelyne Gascon, on peut lire que la propriétaire allègue que ses locataires sont responsables de la présence de moisissures dans l’appartement. La juge décide que la preuve en ce sens n’est pas suffisante.</p>
<p>Métro n’a pas été en mesure de rejoindre le Projet Genèse en fin de journée mardi pour savoir si ces causes devraient être incluses dans le calcul de la longueur moyenne des délais, et si cela pourrait affecter le constat.</p>

<p>The group protested outside the Montreal offices of Pierre Moreau, minister responsible for the tribunal, and called for an end to « interminable » waiting times, dubbing the Quebec agency the « Régie du lentement. »</p>
<p>The group borrowed the hostage theme from the Canal Vie show Proprio en otage, a populist look at landlords&rsquo; experiences with difficult tenants. Tenants, however, says Project Genesis&rsquo; Claire Abraham, are struggling to be treated faily by the tribunal when their rights are violated.</p>
<p>« The statistics often quoted &#8211; an average delay of 21  months for the category that includes causes of unsanitary conditions and lack of heating &#8211; does not mention the reality endured by tenants who are being held prisoner of a dysfunctional and ineffective justice system. »</p>
<p>Romina Hernandez of POPIR &#8211; Comité Logement says the government has been unresponsive to calls for change. « We went directly to Moreau&rsquo;s office because it&rsquo;s been months and months that we are trying to communicate with the Minister without success. For years Quebec tenants have been documenting abuses and sending letters without a response. »</p>
<p>The current Régie system, say advocates, prioritizes the interests of owners at the expense of the rights of tenants. « The latest measures proposed by the government &#8211; hiring of special clerks and commissioners &#8211; had no impact on the waiting times for tenants. These resources only serve to maintain short deadlines for the owners&rsquo; issues,  » said Abraham.</p>
<p>Tenants&rsquo; rights groups are demanding that Moreau ensure the tribunal does not dismiss tenant&rsquo;s health and safety in pursuit of protecting financial interests of landlords, and any reform should seek to establish and equitable, transparent and timely system.</p>

In this interview Claire outlines the ways in which the collective rights of tenants are being systemically violated by the state organizations which is suppose to protect tenant rights. <p>Reading the newspaper, you might be convinced that we are living in a province teetering on bankruptcy and can’t afford our social programs. That is certainly the line that we are being expected to swallow by the Quebec government, with its incessant calls to reduce spending in all ministries. We are being told that cuts, affecting the poorest and lower middle class, will solve our problems, without any recognition of the control the government has on its revenue stream.</p>
<p>Recently it was leaked to the media that the Minister of Employment and Social Solidarity, François Blais, was considering cutting the welfare cheques of people living with more than one roommate, a choice many have to make when living on a monthly income of only $610. However, we have not heard any rumours yet about Finance Minister Carlos Leitão planning to restore the tax on capital for financial institutions, something that could bring in about $600 million a year.</p>

<p>When the government explores ways to increase its revenue, it turns to user fees and consumption tax hikes — regressive measures that again punish those with the lowest incomes, while leaving untouched such gifts to the wealthy as the tax deductions for capital gains. Abolishing this tax deduction would be estimated to increase government revenue by $739 million a year, more than triple the $220 million the Ministry of Employment and Social Solidarity is being asked to trim from its budget.</p>
<p>We have been making these choices for a long time now and the impact is undeniable. Just 10 years ago, the poorest among us were living at their wits’ end, making only 60 per cent of what they needed to survive. Today they make less than 49 per cent of subsistence income.</p>
<p>Wealth inequality is even more worrisome, as Statistics Canada data show that the top 10 per cent of Quebecers own 43.4 per cent of the province’s wealth, while the bottom half of the population owns only 7 per cent of the wealth. In other words, most of the population owns little or nothing, with no nest egg to cushion them from misfortune and the major gaps in the social safety net that is supposed to prevent them from falling into destitution.</p>
<p>These people come into Project Genesis all the time — minimum-wage workers, the precariously employed, the over or under qualified. They fall sick, or have an accident, can’t work or can’t find work, and suddenly can’t pay the rent. They ask us what benefits they are entitled to. And we are obliged to say that there is almost nothing for them, that welfare requires them to liquidate their bank accounts and then will give them a benefit that is so low they are likely to still be unable to pay the rent. As for social housing, there’s not enough of it to go around and new units are few — thanks once more to austerity.</p>
<p>How to explain this situation to the person faced with going to the food bank for the first time?</p>
<p>Rather than continuing this merry-go-round of cuts to services to finance tax cuts leading to further cuts to services, it might actually be time for an honest conversation on the type of society we want to have.</p>
<p>Do we want to continue to witness a worsening situation for most households, the bottom and middle included, or do we want instead to strengthen our social safety net and actually get at the root cause of our budget situation?</p>

<p>Une cinquantaine de personnes se sont transformées en zombie le temps d’une manifestation au centre-ville de Montréal jeudi matin, pour protester contre les longs délais à la Régie du logement.</p>
<p>«L’idée, c’est que ça fait tellement longtemps que les gens ont déposé leur plainte à la Régie qu’ils doivent revenir de la mort pour assister à leur audience», a expliqué Claire Abraham, organisatrice communautaire au Projet Genèse.</p>

<p>Projet Genèse et d’autres groupes de défense des droits des locataires déplorent que les délais moyens soient de presque deux ans pour obtenir une audience pour une «cause civile générale», ce dans quoi tombent 85% des plaintes de locataires. Cela inclut notamment des plaintes pour des moisissures, de la vermine, du chauffage inadéquat ou des réparations non effectuées.</p>
<p>«Même si les causes sont censées être traitées plus rapidement lorsque la santé ou la sécurité du locataire est en danger, on constate que ce n’est pas toujours le cas et il y a des gens qui sont restés deux ans dans leur logement insalubre», a souligné Mme Abraham.</p>
<p>Les organisations de locataires en ont contre le système de traitement des plaintes, qui donne la priorité à celles pour non-paiement de loyer. «Si tous les types de plaintes étaient traités sur un pied d’égalité, le délai serait de 4,6 mois», a fait valoir Mme Abraham.</p>
<p>Les organisations de locataires en ont contre le système de traitement des plaintes, qui donne la priorité à celles pour non-paiement de loyer. «Si tous les types de plaintes étaient traités sur un pied d’égalité, le délai serait de 4,6 mois», a fait valoir Mme Abraham.</p>
<p>«Cette façon de traiter les demandes à la Régie du logement fait en sorte que, dans les faits, on fait primer les intérêts économiques, les profits des propriétaires, sur la santé, la sécurité et la qualité de vie des locataires», a de son côté réagit Manuel Johnson, avocat aux Services juridiques communautaires de Pointe-Saint-Charles et de la Petite-Bourgogne.</p>
<p>«Il faut que les causes de non-paiement de loyer soient traitées en urgence, estime au contraire Hans Brouillette, directeur des communications à la Corporation des propriétaires immobiliers du Québec (CORPIQ). Plus ça prend du temps avant de pouvoir évincer un locataire, plus les propriétaires perdent de l’argent qu’ils ne sont pas certains de pouvoir récupérer à la fin.» Il estime que les locataires fautifs disparaissent souvent ou ne sont pas solvables, alors que les propriétaires reconnus coupables sont presque toujours en mesure de dédommager les locataires lésés en bout de ligne.</p>
<p>Le ministre des Affaires municipales et de l’Occupation du territoire, Pierre Moreau, se dit conscient qu’il faut travailler à réduire les délais à la Régie et s’est engagé à revoir les façons de faire. Il a déjà annoncé la nomination de quatre greffiers spéciaux qui entendront les demandes non-contestées de recouvrement de loyer et de résiliation de bail. «Nous continuons de travailler étroitement avec la Régie du logement à la recherche de solutions», a fait savoir son attachée de presse, Catherine Poulin.</p>

Housing advocates have been campaigning for many years to reduce wait times for a hearing, but the problem has only worsened.</p>
<p>“Compared to last year it has gotten a lot slower,” says Arnold Bennett who runs a housing clinic and hotline out of the YMCA. “Now tenants are routinely told their case is going to take over two years, even three years involving repairs.”</p>

<p>The Régie classifies each case in one of five categories, based on the course of action requested by the claimant: non-payment of rent, rent fixation and revision, and urgent, priority or general civil cases. Non-payment of rent, filed by landlords makes up the majority of the cases, and is considered urgent. Those cases are typically heard within 1.4 months while general civil cases, mostly filed by tenants, are heard in an average of 20.7 months, according to the Régie’s most recent annual report.</p>
<p>Complaints regarding mould, vermin and repairs fall under the general civil category and can take as long as 22 months to be heard, says Fred Burrill of Popir-Comité de logement, with tenants forced to wait in inconvenient to untenable situations, such as a chronic leak from an upstairs toilet flooding their living room on a daily basis.</p>
<p>“The one thing you are absolutely not allowed to do as a tenant is to withhold rent as a form of protest,” Burrill says. Leaving an unsanitary dwelling is not always possible. “Oftentimes people are not going to find another apartment that is cheaper. In Montreal rents are increased by a significant percentage, with people paying 50 to 80 per cent of their monthly income. Anybody living on a fixed income is bound to find themselves in that situation.”</p>
<p>Project Genesis community organizer Claire Abraham says the disparity in waiting times between landlords and tenants is unacceptable. “The Régie says it is obligated to hear non-payment cases quickly because of the harm caused to landlords if they default on mortgage payments but it disregards the prejudice caused to tenants who are forced to live in terrible conditions.” She said tenants are not informed of how their case is prioritized, and have no way of knowing how long they will be waiting.</p>
<p>Régie du Logement spokesperson Denis Miron says non-payment cases are urgent both for tenants and owners, since renters risk eviction if they don’t pay their rent.</p>
<p>“A case is considered urgent if it represents a threat for health and security, or if it involves possible eviction,” Miron says, noting that wait times for all cases classified as urgent are similar. However, in situations where there is no immediate threat, such as mice or cockroach infestations, it is up to the plaintiff to prove how serious the problem is. “If you see [vermin] in your apartment it doesn’t necessarily represent a threat to your health. Mould could be a threat, but the tenant has to prove it is a real threat.”</p>
<p>Miron denies there is any systemic bias at the Régie, as tenants’ rights organizations have charged. “There is somebody here at the rental board to look at all recourses who decides how to categorize, then in each category, cases will be treated on a first come first served basis, whether it is from a landlord or tenant.”</p>
<p>Bennett disagrees. “Priority to non-payment of rent cases is biased. Their priority is to evict tenants who aren’t paying their rent, which is understandable if this is a landlord’s only income, but basically they are doing it for big corporations as well, who can afford to wait.</p>
<p>“You have to fight to get [the Régie] to hear urgent repair cases,” Bennett says, “Health and fire hazards could be heard quickly, but it is not built into the system, not guaranteed.”</p>
<p>He tells tenants to obtain a report from a city inspector, which will be taken “very seriously” and in extreme cases to write to the Régie’s executive secretary in the hope that their case will be fast tracked, but compares it to playing a lottery.</p>
<p>Miron advises tenants to get help from tenants’ rights groups, who can also advise how to refuse unlawful rent increases. “The tools are there, learn to use them to the maximum. Get help to fill out forms from Project Genesis and other housing groups.”</p>
<p>With the housing stock getting older, wait times are bound to get worse.</p>
<p>The Regroupement des comités logement et associations de locataires du Québec (RCLALQ) wants all cases, regardless of category, to be heard in chronological order within three months and urgent cases (pertaining to health and security) within 72 hours.</p>
<p>“<span lang="en-US">Impossible,” says Miron. “Every year we have new demands, 100,000 for 42 judges. It would be easier if we had 100 judges but it would cost the taxpayers more.” Advocates would like to see more money allocated to the Régie. “The provincial government needs to be responsible to tenants in Quebec and reinvest in the Rental Board so it can do its job,” Burrill says.</span></p>
